01What you're agreeing to
These terms govern your use of AnyRun (the Platform), operated by AnyRun ("we", "us"). AnyRun is a registered Australian business name, based in South Australia. By creating an account, entering an event, volunteering, buying a sponsor placement, or otherwise using the Platform, you agree to them. If you use the Platform for an organisation, you confirm you're authorised to bind it.
How the legal pack fits together: these terms are the base layer. The Privacy Policy and Cookie Policy sit alongside them, and three specific relationships get their own documents: the Participant Terms for runners, the Organiser Agreement for event organisers, and the Sponsor Terms for sponsors. If a specific document conflicts with this one, the specific document wins for that relationship; because it was written for it.
02Who can hold an account
You must be at least 16 years old to hold an account. Entries for participants under 18 are made or approved by a parent or guardian, and school-event entries run through the organiser. Keep your sign-in secure (that's why we offer two-factor authentication and recommend a pass phrase) and you're responsible for what's done under your account. One fair limit: if your account is used without your authority, tell us as soon as you become aware of it, and you're not responsible for unauthorised activity after you've told us, or for activity that our own security failure allowed.
03What the Platform does
AnyRun lets organisers create and run events, and lets participants register, pay, volunteer, follow clubs, view official results, and receive photos matched to them. Official results are certified by chip timing; photos attach by bib matching with human review. It is not facial recognition (see the Privacy Policy for the full stance).
We add, change and remove features as the Platform grows. We aim for high availability (registration and checkout above all), but no online service can promise to be available and error-free every minute, and we don't.
04The platform and your event
AnyRun provides the technology and the support for it, nothing more. The software (registration, payments infrastructure, timing tools, results, communications) and the support behind it are our responsibility. The events created on it are not: every event is staged, owned and answered for by its organiser.
The organiser is the merchant of record for their event. When you buy an entry, the sale is the organiser's. Card payments are processed by Stripe and settle directly to their own Stripe account, the organiser stands behind the charge, and refunds are paid from that account under their published policy. AnyRun does not hold event funds. The only money we receive is our published platform fee, taken per cart and itemised before you pay.
Event responsibility sits with the organiser. That covers the event itself (safety, permits, insurance) and its published policies: the privacy statement, refund policy and participation waiver attached to each event are the organiser's documents. We do not write them. We hold organisers to these obligations in the Organiser Agreement, and nothing in this section limits your rights under the Australian Consumer Law.
05One account, every hat
Each person holds one account. The same account runs races, volunteers, sponsors and organises: your passport gains stamps. Your race history stays in one place, and an organiser sees you only where you are connected to their event, through an entry, a volunteer shift, or a club membership. You agree to keep the information on your account accurate.
06Fair use
Using AnyRun, you agree not to:
- break the law or infringe anyone's rights;
- upload content you have no right to upload, including images of people without a proper basis, or anything unlawful, harmful or offensive;
- enter an event under another person's identity;
- try to access data that isn't yours;
- scrape, harvest or bulk-extract data: start lists, results and galleries exist for the running community, and we rate-limit and act on misuse;
- use the Platform, or the content on it, to train or fine-tune a machine-learning model, or to assemble a dataset for that purpose, whether you do it yourself or instruct an automated agent to do it for you;
- interfere with the security or normal operation of the Platform.
07Your content and event media
You keep ownership of what you upload. You grant us, and the relevant organiser, the licence needed to host, process and display that content to run the event and the Platform: attaching photos to participants, showing published results and galleries as configured. That licence extends to the service providers who host and process content on our behalf, and it lasts only as long as the content is on the Platform: remove a photo, or have your account erased, and the licence for it ends with it, save for short-lived routine backup copies. Nothing more: the licence exists so the product can function. It does not extend to reselling your content.
Photographers and organisers who upload media confirm they hold the rights and permissions to do so. Participants can remove their own matched photos at any time, and organisers control which images are featured publicly.
08Payments and fees
Entry prices are set by organisers. AnyRun charges one platform fee per cart, whatever number of items the cart holds, itemised on screen before you pay, so the total you see is the total charged. The published schedule:
- Standard rate: A$0.99 per cart, ex GST, plus a marginal percentage of the cart subtotal: 4.9% on the first A$100, 3.9% on the portion from A$100.01 to A$300, and 2.9% on everything above A$300. Marginal means each slice of the cart is charged its own band's rate, the way income tax brackets work. On a A$150 cart, 4.9% applies to the first A$100 and 3.9% to the remaining A$50.
- Community rate: a flat 2.9% + A$0.99 per cart, ex GST, for registered charities, schools and not-for-profits.
- The fee cannot exceed the cart. On micro-priced carts the fee and its GST are capped together, so the two of them stay inside the cart subtotal and a small entry stays worth taking. A cart with a A$0.00 subtotal carries no platform fee.
- One-time account authorisation fee: A$29.00 ex GST, plus A$2.90 GST, charged as A$31.90 once when an organisation connects its payout account, with your consent recorded on the connect screen before anything is charged. It goes towards the Stripe Radar fraud monitoring applied to the organiser’s connected account. It is not a subscription, does not recur, and is separate from the per-cart fee; a tax invoice is issued.
- Storage packs: 100 GB for one calendar month for A$5.00, ex GST, each. A month is not refunded once it has started.
- Organiser emails: 500 a month are included; beyond that, A$1.00 per 1,000 messages, ex GST, metered per month, or prepaid packs of 5,000 messages for A$5.00, ex GST.
- All amounts are in Australian dollars, and every fee above is stated ex GST. GST is added to the fee and shown as its own line at checkout, on your receipt and on the tax invoice, so the total on screen is the total charged.
A community rate applies to not-for-profits, registered charities and schools. Who pays the fee (the runner on top, the organiser out of the price, or a split) is the organiser's choice and is visible in the itemised cart. Payments are processed by our payment providers; entry funds flow to the organiser under the Organiser Agreement. Refunds are governed by the organiser's policy and the Participant Terms, and nothing anywhere in these terms limits your rights under the Australian Consumer Law.
If you dispute a payment with your bank. A chargeback is your right and nothing here discourages one, but it is the slowest route, because the payment sat with the organiser and the outcome is decided by your card issuer. Ask the organiser first and us second: a refund an organiser approves reaches you in days. When an issuer opens a dispute we record it against the order, tell the organiser what it is for and when their evidence is due, and the entry it relates to may be cancelled while it runs. None of this affects your rights under the Australian Consumer Law or under your card scheme's own rules.
09Intellectual property
The Platform (its software, design system and brand) is owned by us or our licensors. You get a limited, non-exclusive, non-transferable right to use it for its intended purpose. You may not copy, resell or reverse-engineer the Platform except where the law allows it regardless of what a contract says.
We expressly reserve the right to text and data mining in this site. No permission is given to reproduce, copy, scrape, extract or mine these pages or their content, or to use them to train or fine-tune a machine-learning model, and every page carries that refusal: a copyright notice and a declaration addressed to automated agents, and the licence link in each page's head points here, because this document is where a permission would have to come from. Reading a page in a browser, linking to it, and the uses Australian copyright law allows whatever a contract says (fair dealing among them) are untouched by this clause. Our crawl policy at /robots.txt is a narrower, separate thing: it keeps crawlers out of data endpoints, exports and anything behind a sign-in, and it is not a grant of permission over what it leaves open.
10Services we rely on
The Platform runs on third-party services: hosting, payments, timing hardware, mapping. We choose them deliberately and hold them to protective contracts (the current categories are listed in the Privacy Policy), but your use of a third party's own service is subject to their terms, and we can't be responsible for a third party beyond our reasonable control.
11What we promise, and what we can't
We provide the Platform with reasonable care and skill, within two limits:
- Photo matching is automatic tagging. It depends on lighting, angle and how a bib is worn. We cross-check against chip times and put a human on uncertain matches, but we don't guarantee every participant gets a photo or that every match is correct. The photo layer decides nothing; chip timing is the source of truth for results.
- Events are run by organisers. The conduct and outcome of an event (including whether it goes ahead) is the organiser's responsibility.
12Your consumer rights come first
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms, or in any other AnyRun document, excludes, restricts or modifies those guarantees. This clause outranks everything else here: if any other clause reads as cutting into a non-excludable right, this one wins.
13Liability and indemnity
Subject to the consumer-law section above, and to the extent the law permits: neither you nor AnyRun is liable to the other for indirect or consequential loss (including loss of profits, data or goodwill), and each party's total liability arising from the Platform is capped at the greater of the platform fees paid to AnyRun in the twelve months before the claim and A$200. This mutual cap does not apply to fraud, to a party's own reckless or wilful misconduct, to liability for death or personal injury caused by a party's negligence, or to any liability that cannot be limited at law. AnyRun is not liable for the conduct of organisers, participants, timers, sponsors or other users, or for the running or cancellation of any event.
If you use the Platform as a business (organiser, sponsor, or other commercial user) you indemnify us against third-party claims arising from your event, your content or your breach of these terms, but only to the extent the claim is caused by you, and it stops where the cause is AnyRun's own negligence or breach. A business carries the risk it creates. We carry the risk we create. We do not ask consumers (runners entering an event) for any indemnity.
14Data security and incidents
We protect your data with best-practice measures on the architecture we use: field-level encryption of the most sensitive information, row-level security enforced in the database, TLS on every connection, and access controls (the full engineering picture is on the Security page). No system is perfectly secure, and we do not claim ours is: by using the Platform you acknowledge that we cannot absolutely guarantee against unauthorised access, and that our commitment is to take reasonable steps. No provider can promise a result, and neither do we.
If an eligible data breach occurs that is likely to result in serious harm, we will assess it and, where the law requires, notify the Office of the Australian Information Commissioner and the affected people as soon as practicable under the Notifiable Data Breaches scheme, and the relevant EU or UK authority where the GDPR applies. Nothing in this section limits your rights under the Privacy Act 1988 (Cth), the Australian Consumer Law, or any other law that cannot be excluded.
15Events beyond anyone's control
Neither you nor AnyRun is in breach of these terms for a failure or delay caused by something genuinely outside that party's reasonable control: a natural disaster, war, epidemic, government direction, a widespread internet or power outage, or critical infrastructure providers going down. The same shield covers both sides. Whoever is affected tells the other side without undue delay, takes reasonable steps to work around the problem, and picks the obligations back up when it passes. Two things this clause leaves untouched: payment for what was already delivered, and any right you hold under the Australian Consumer Law: a cancelled event still opens the refund path in the Participant Terms.
16Suspension and closing your account
You can close your account at any time: the Privacy Policy describes what happens to your data. We may suspend or limit access if you breach these terms, misuse the Platform, or create a legal or security risk. We act proportionately and, where practical, with notice. Suspension is a safety valve.
What suspension doesn't touch: an entry you already hold is a contract with its organiser and stands on its own, and your rights over your data (export, correction and erasure under the Privacy Policy) are statutory, so they survive any suspension. If you think we've got it wrong, reply to the suspension notice or write to support@anyrun.net and a human will review the decision.
A security lock is not a suspension. If a password or a two-factor code is tried and failed ten times inside fifteen minutes, that check stops accepting attempts for fifteen minutes from the last one. It is automatic, it is temporary, it says nothing about your standing with us, and it lifts when the fifteen minutes end: there is nothing to appeal and nobody to ask. We tell you when one engages, because the usual reason is somebody else guessing.
17Changes to these terms
These terms change by publishing a new version. When we make a material change we update the version and effective date at the top of this page, and where a change reduces your rights or adds to your obligations we give reasonable advance notice before it takes effect, so you can read it, ask us about it, or close your account before it applies to you. Changes are not retrospective: the version you accepted is recorded against your account at signup and again at each entry, so the text that applied at the time is on record. Using the Platform after a change takes effect means the new version governs that use, and only that use.
18If we disagree
Talk to us first: it's faster for both of us. Write to support@anyrun.net with what happened and what you'd like done. We acknowledge complaints within 5 business days and aim to resolve them within 30 days, and both sides agree to try this genuinely before starting formal action.
Nothing here limits going to court. This process does not limit your right to complain to Consumer and Business Services SA or the ACCC, to apply to a tribunal, or to go to court. These terms contain no forced arbitration and no class-action waiver.
19The plumbing: severability, assignment, survival
If a clause fails, the rest stand. If any part of these terms is void (including under the unfair contract terms regime) or unenforceable, that part is severed and everything else keeps working.
Accounts are personal; the business could change hands. You can't transfer your account: it's your identity and race history, and that's the point of it. We may transfer this agreement if AnyRun's business is sold or restructured, but only to someone who takes on our obligations under it, and we'll tell you before it happens, your rights under these terms and the Privacy Policy carry across unreduced.
These documents are the whole deal, with one exception. These terms, the specific document for your relationship, and the Privacy and Cookie Policies are the entire agreement between us about the Platform. But no entire-agreement clause can erase the law: nothing here excludes liability for misleading or deceptive conduct, or any right the Australian Consumer Law or the Privacy Act gives you regardless of contract.
Some clauses outlive your account. Closing your account ends this agreement, but the clauses built to survive it keep operating: consumer-law supremacy, the liability and indemnity positions, intellectual property, confidentiality of anything already shared, lawful data retention under the Privacy Policy, and this section itself.
20Governing law and contact
These terms are governed by the laws of South Australia, Australia, and the courts of that state have jurisdiction, without limiting any non-excludable right you have to bring a matter elsewhere. Questions about these terms: support@anyrun.net.
