Participation waiverv1
First Light Community Run: participation waiver
By entering First Light Community Run at Daybreak Cove Sea Wall, Daybreak Cove, SA on 3 Dec 2026, 6:15 am, I declare and agree:
- Fitness and preparation. I am medically fit to take part, and it is my responsibility to be adequately prepared. I will withdraw if event or medical staff direct me to, and I agree the organiser may arrange first aid or emergency treatment for me if I cannot consent at the time.
- Risk warning, and my acceptance of the risk. This clause is a risk warning. First Light Community Run is a recreational activity that carries real and inherent risks of harm, including death and serious injury. Those risks include uneven, wet or slippery surfaces; heat, cold and other weather; collisions with other participants, vehicles, animals or objects; traffic on or beside the course; my own physical condition, including cardiac events, heat illness and dehydration; and the acts or omissions of other people. This warning is general: it is not tailored to me and I have not asked for advice about my own position. I accept that these are obvious risks, that this event may be a dangerous recreational activity under the civil liability law of the state or territory where it is held, and that I take part at my own risk.
- Who this waiver protects. In clauses 4 to 6, the released parties means: Daybreak Cove Foundation, the organiser of this event; its officers, employees, volunteers, contractors, suppliers and sponsors; the owners and occupiers of the land, venue, roads and facilities the course uses, and any council, park or road authority that permits it; and AnyRun (ABN 90 374 636 715), which supplies the registration and results technology for this event: AnyRun is a registered Australian business name, based in South Australia. Daybreak Cove Foundation gives and accepts clauses 4 and 5 both on its own behalf and as agent and trustee for each of the other released parties, so that each of them may rely on those clauses in their own right.
- Release: death and personal injury. To the maximum extent the law allows, I release the released parties from liability for death, physical injury, mental injury (including nervous shock), disease or illness that I suffer arising out of or in connection with my participation in First Light Community Run, and I agree not to make a claim against them for it. This clause is limited to those things and to nothing else. It does not touch loss of or damage to property, or any other kind of loss, which clause 5 deals with separately and on a different legal basis. It does not release anyone for reckless conduct, and it does not exclude, restrict or modify anything the law does not permit to be excluded, restricted or modified. Clause 6 and the jurisdiction schedule at the end say what that means here.
- Other loss: property, money and everything else. It is separate from clause 4 and forms no part of it, deliberately: the law that lets a recreational-services supplier exclude liability for death and injury reaches death, injury and disease only, so nothing in this clause relies on it. What I accept is that the released parties are not the insurer of my belongings: bag drop, gear tents, parking and anything I leave at the event are used at my own risk, and I will not leave valuables. Where the law permits a limit, the released parties' liability for loss of or damage to my property, or for travel, accommodation or other costs I incur, is limited to re-supplying the entry or refunding my entry fee, at their option. What this clause does not do is take away my rights where loss is caused by the released parties' own failure to take reasonable care: for a consumer those rights cannot be signed away in Australia, and this waiver does not pretend otherwise.
- Rights this waiver cannot take away, and does not try to. Nothing in this waiver excludes, restricts or modifies any consumer guarantee, right or remedy I have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Nothing in it releases anyone for reckless conduct. If any clause reaches further than the law allows, it operates only as far as the law allows and no further, and the rest of the waiver still stands.
- Rules and instructions. I will follow the published event rules and the directions of marshals, officials, medical staff and emergency services, and I understand I may be withdrawn from the event for my own safety or for the safety of others.
- Media. Event photography operates by bib-number matching; my photos appear in my own account, and public visibility follows my AnyRun settings.
- My details. The information I entered is true, and my emergency contact may be called if needed.
- If I am 16 or 17. AnyRun lets people aged 16 and over enter and accept this waiver for themselves, and I may have done that. Australian law limits how much a person under 18 can sign away. In South Australia the prescribed exclusion can only be agreed to by someone aged 18 or over, and a parent or guardian cannot agree to it on a child's behalf either; other states and territories treat a minor's waiver differently again. So if I am under 18, clauses 4 and 5 may not bind me at all, and this document does not claim that they do. Everything else still applies: I must be fit and prepared, I accept the risks described in clause 2, I will follow instructions, and my details must be true. I confirm a parent or guardian knows I am entering, and I understand the organiser may ask a parent or guardian to countersign this waiver, or may decline my entry, where the law of the event's state requires an adult signatory.
- Governing law and severability. This waiver is governed by the law of South Australia. If any part of it is unenforceable, the rest still applies. My participation is voluntary, and I do not have to agree to clauses 4 or 5. If I do not, the organiser may decline my entry.

EXCLUSION, RESTRICTION OR MODIFICATION OF RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW (SA)
(Fair Trading Act 1987 (SA) s 42 · Fair Trading Regulations 2025 (SA) reg 8, Schedule 1 Form 1)
Your rights:
Under sections 60 and 61 of the Australian Consumer Law (SA), if a person in trade or commerce supplies you with services (including recreational services), there is—
- a statutory guarantee that those services will be rendered with due care and skill; and
- a statutory guarantee that those services, and any product resulting from those services, will be reasonably fit for the purpose for which the services are being acquired (as long as that purpose is made known to the supplier); and
- a statutory guarantee that those services, and any product resulting from those services, will be of such a nature, and quality, state or condition, that they might reasonably be expected to achieve the result that the consumer wishes to achieve (as long as that wish is made known to the supplier or a person with whom negotiations have been conducted in relation to the acquisition of the services).
Excluding, restricting or modifying your rights:
Under section 42 of the Fair Trading Act 1987, the supplier of recreational services is entitled to ask you to agree to exclude, restrict or modify their liability for any personal injury suffered by you or another person for whom or on whose behalf you are acquiring the services (a third party consumer).
If you agree, you will be agreeing to exclude, restrict or modify the supplier's liability with the result that compensation may not be payable if you or the third party consumer suffer personal injury.
Important
You do not have to agree to exclude, restrict or modify your rights. The supplier may refuse to provide you with the services if you do not agree. Even if you agree, you may still have further legal rights against the supplier. A child under the age of 18 cannot legally agree to exclude, restrict or modify their rights. A parent or guardian of a child who acquires recreational services for the child cannot legally agree to exclude, restrict or modify the child's rights.
Agreement: I agree that the liability of Daybreak Cove Foundation (the supplier of recreational services) for any personal injury that may result from the supply of the recreational services that may be suffered by me is excluded, to the extent permitted by section 42 of the Fair Trading Act 1987 (SA). Personal injury is bodily injury and includes mental and nervous shock and death. Nothing in this agreement excludes liability for significant personal injury caused by the supplier's reckless conduct (s 42(3)), and any indemnity for liability that cannot lawfully be excluded is void (s 42(4)). You may request a copy of your completed acceptance record at any time and it will be provided within 7 days. Further information: www.cbs.sa.gov.au.
This waiver is issued by Daybreak Cove Foundation, the event organiser and merchant for this event, who is responsible for its terms. AnyRun supplies the registration technology and is a named released party under clause 3; it is not the supplier of the recreational activity and gives no legal advice to anyone.
Event privacy statementv1
First Light Community Run: event privacy statement
Daybreak Cove Foundation ("the organiser") collects entrant details through the AnyRun platform to run First Light Community Run at Daybreak Cove Sea Wall, Daybreak Cove, SA on 3 Dec 2026, 6:15 am.
What we collect and why. Name, date of birth, contact and emergency-contact details: used for event administration, safety planning, timing and results. We do not collect health or medical information. Bib-matched race photos appear in your own AnyRun account.
What we publish. Start lists and results show your name and result only per your own AnyRun visibility settings. We never publish your contact details.
Who sees it. The organiser's event team accesses entrant details on a need-to-know basis (check-in, safety, timing). Data is hosted by AnyRun in Sydney, Australia; AnyRun's own privacy policy covers the platform layer.
Retention & questions. We keep entry records only as long as event administration requires. Questions or removal requests: hello@daybreakcove.example.
This statement is published and maintained by Daybreak Cove Foundation, who is responsible for its accuracy. AnyRun provides the technology platform only.
Refund & transfer policyv1
First Light Community Run: refund & transfer policy
Refunds and transfers are available on request until entries close. Contact us or manage them from your AnyRun account.
If we cancel or materially change the event. If First Light Community Run cannot proceed as published (including for weather or safety directions), the organiser will announce the alternative on the event page and by direct notice to entrants: a refund, a transfer to a future edition, or a changed course.
How refunds are paid. Approved refunds return to the original payment method. Payments for this event are made to Daybreak Cove Foundation. AnyRun does not hold event funds.
The AnyRun platform fee and its GST are not refundable. A refund returns the entry price you paid Daybreak Cove Foundation. The AnyRun platform fee and the GST on it, itemised separately at checkout, are not returned: the fee pays for a service already delivered at registration, and Daybreak Cove Foundation's refund tools cannot return either. This holds when Daybreak Cove Foundation cancels the event as well: the entry price is returned, and the platform fee and its GST are not. Where AnyRun itself causes a refund, AnyRun makes the order whole. Nothing here limits the rights the Australian Consumer Law gives you.
Questions. hello@daybreakcove.example.
Nothing in this policy limits remedies available under the Australian Consumer Law.
This policy is set and honoured by Daybreak Cove Foundation. AnyRun provides the technology platform only.
Merchandise & add-on termsv1
First Light Community Run: merchandise & add-on terms
Daybreak Cove Foundation ("we", "the seller") sells the add-on items listed with First Light Community Run: race merchandise, engraving, extras and event tickets. We are the seller of these items. AnyRun provides the listing and checkout and collects payment on our behalf; the contract for the goods is between you and us.
Prices. All prices are in Australian dollars. Our prices include GST where GST applies to us. The AnyRun platform fee is stated ex GST, with GST added as its own line, and both are shown separately at checkout. Neither the fee nor its GST is refundable: a refund returns the item price. That applies whether you cancel or the event does not go ahead. Nothing here limits the rights the Australian Consumer Law gives you.
Collection at the event. Collect-on-day items are handed over at: Collect at the foundation tent.. Bring your order confirmation. If you cannot attend, contact us before race day to arrange something. We cannot guarantee an item will still be available afterwards.
Tracking your order. Each item you buy shows a fulfilment status on your AnyRun race page: being prepared, then shipped or collected. We keep it current.
Change of mind. Merchandise is ordered to the number sold, so we cannot accept returns or exchanges simply because you have changed your mind or chosen the wrong size. Please check the size guide before you buy.
Your consumer guarantees. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies those rights. That includes the change-of-mind position above.
If something is wrong. Contact us at hello@daybreakcove.example with your order reference and what happened, and we will sort it out.
If the event does not go ahead. An item you have not received for an event that does not happen is refundable. Where you have already received the goods, they were supplied and the position depends on what arrived.
These terms are set and honoured by Daybreak Cove Foundation, the seller of these goods. AnyRun provides the marketplace and payment technology only, and is not the supplier of the goods. AnyRun's own [Add-on Marketplace Terms](/addon-terms) cover the platform layer.
